1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website operated by Abounding Grace Foundation ("AGF", "we", "us", or "our"), including all content, features, donation services, volunteer applications, and community features available on this site (the "Website"). By accessing or using the Website, making a donation, registering an account, or applying to volunteer, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.

2. About Abounding Grace Foundation

Abounding Grace Foundation is a non-profit organisation, founded in 2013, dedicated to rehabilitating prisoners and ex-convicts across Nigeria, Ghana and the United Kingdom through our RRR model — Rehabilitation, Reformation, and Re-Integration. We operate registered offices in the United Kingdom, Nigeria, and Ghana.

3. Eligibility and Account Registration

To access certain features of the Website, such as making recurring donations, tracking your donation history, or joining a community, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain the security of your password and accept responsibility for all activities under your account;
  • Notify us immediately of any unauthorised use of your account;
  • Be at least 16 years old, or have the consent of a parent or legal guardian, to register an account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or for any unlawful purpose.

4. Donations

4.1 Making a Donation

Donations made through the Website may be one-time or recurring, and are processed through our third-party payment partners (which may include Paystack, Stripe, PayPal, and Flutterwave). By making a donation, you represent that you are authorised to use the payment method provided and that the information you supply is accurate.

4.2 Recurring Donations

If you set up a recurring donation, it will continue to be charged at the frequency you select until you cancel it through your account dashboard or by contacting us at info@prisonervoice.com. You may cancel a recurring donation at any time; the cancellation will take effect before the next scheduled payment, provided you cancel with reasonable notice.

4.3 Refunds

Donations are generally non-refundable, as funds are often allocated to programmes promptly. However, if you believe a donation was made in error (for example, due to a duplicate transaction or technical fault), please contact us at info@prisonervoice.com within 14 days of the transaction, and we will review your request in good faith on a case-by-case basis.

4.4 Use of Funds

Donations are used to support our RRR programmes, outreach work, legal aid clinic, youth crime prevention initiatives, and general operations, as described on our Website. Where a campaign specifies a particular purpose, we will make reasonable efforts to apply funds accordingly, but we reserve the right to reallocate funds to similar programmes if a specific campaign is over-funded, under-funded, or no longer viable.

4.5 Tax Receipts

Where applicable and available in your jurisdiction, we will issue a donation receipt to the email address provided. It is your responsibility to determine whether your donation is tax-deductible in your country of residence.

5. Acceptable Use of the Website

When using the Website, you agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;
  • Submit false, misleading, or fraudulent information, including in relation to donations or volunteer applications;
  • Attempt to gain unauthorised access to any part of the Website, other user accounts, or our systems;
  • Upload or transmit viruses, malware, or any code designed to disrupt the Website;
  • Harass, abuse, defame, or threaten any other user, volunteer, staff member, or individual referenced on the Website;
  • Post content in community or discussion features that is unlawful, hateful, discriminatory, sexually explicit, or infringes the rights of others;
  • Scrape, copy, or reproduce content from the Website for commercial purposes without our written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to remove any content and suspend or terminate access to the Website for any user who violates this section.

6. Community and User-Generated Content

Where the Website allows you to join a community, post comments, or otherwise submit content ("User Content"), you retain ownership of your User Content, but you grant Abounding Grace Foundation a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Website and our programmes. You are solely responsible for the User Content you submit and confirm that it does not violate any law or the rights of any third party.

We reserve the right, but are not obligated, to monitor, review, and remove User Content at our discretion, including content that violates these Terms.

7. Volunteer and Job Applications

Opportunities listed on our Volunteer Opportunities page are offered on an unpaid, volunteer basis unless explicitly stated otherwise. By submitting an application, you consent to us processing the personal information you provide for the purpose of evaluating your application and, where relevant, contacting you regarding onboarding, background checks, and safeguarding requirements. Submitting an application does not guarantee a volunteer placement. Where a role involves direct contact with vulnerable individuals, including prisoners and ex-convicts, acceptance is subject to satisfactory background checks and completion of our safeguarding training.

8. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of Abounding Grace Foundation or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view, download, and print content from the Website for your own personal, non-commercial use, provided you do not remove any copyright or proprietary notices. Any other use, including reproduction, modification, distribution, or republication, requires our prior written consent.

9. Third-Party Links and Services

The Website may contain links to third-party websites or services, including our payment processors and social media pages, which are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party websites. Your use of third-party websites and services is at your own risk and subject to their own terms and privacy policies.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Website, you consent to the practices described in our Privacy Policy.

11. Disclaimers

The Website and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. 12. Limitation of Liability

To the fullest extent permitted by applicable law, Abounding Grace Foundation, its trustees, staff, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Website, your donation, or your participation in our programmes, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Abounding Grace Foundation, its trustees, officers, staff, and volunteers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Website, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Website or your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our discretion. You may stop using the Website and request closure of your account at any time by contacting us.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles, save that nothing in these Terms shall limit any mandatory consumer or data protection rights you may have under the laws of Nigeria or Ghana where you access the Website from those jurisdictions. Any disputes arising from these Terms or your use of the Website shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Website after any changes constitutes your acceptance of the updated Terms.
